Anna-Marie, maybe you should not just thank God for your good luck in being in the USA but also ask him to help all those unlucky German homeschoolers.

Sorry if my comment seems a bit sharp but I happen to be homeschooling in Germany - and am currently employing a lawyer to fight my case with the school authorities. Our (expat) family is being treated a lot more leniently than many others whom I personally know who have had to flee the country to avoid losing custody of their children or, in the case of one woman who lives near to me, have had had their children forced into psychiatric hospitals by the authorities.

Dana, are you on the Learning Unlimited Email list? There is a lot of discussion of the Konrad case and its ramifications and they are working on how to strengthen the cases of the rest of the applicants to the Court of Human rights.

http://groups.yahoo.com/group/learning-unlimited/?yguid=141787061

Even if you are in the USA, you can join this group if you have an interest in home education issues in Europe.

I so agree with you, Anna-Marie. And there really is no national sovereignty left in the EU. I read a report a while back put out by the EU that was discussing the fact that Europe is still viewed as a collection of individual, independent nations. That was a bad thing? They are really trying to present themselves as a single, unified entity...the United States of Europe.

It appears as if the individual nations have less sovereignty than our states do.

We should thank God that in His providence He chose to place us in the US. So are the parents anything more than just tools of the State, to crank out the future society, feed and clothe them until the State can take over? This whole idea is really sickening.

And I'm also uncomfortable with these smushy courts in Europe. There is really no more sovereignty, only the EU. Strange concept to me, I must say. Makes me sad for the choices they have made. The children pay the price.

If this were just Germany, I wouldn't worry about it so much. I find the support of the European Court of Human Rights in Strassbourg disturbing, not only for homeschoolers but for parents in general. There are several things they could have done to rule in favor of Germany that would not have bothered me, but the way this reads, at least as excerpted by this article, leaves little doubt as to the situation of parental rights.

They recognize that the children are not yet old enough to determine for themselves what is best for them so the only power that can legally make decisions for them is now the state.

I will see if I can find more information on this tonight, but so far most of what I have found has only talked about this case waiting for appeal.

This is the most disturbing story on so many levels. It is sickening to think that the state has more rights than the parent; that the state trumps the family; that the state's "best interests" are what rule a society; that the rules of Hitler still trump the rules of sanity in Germany. It seems as though Germany has yet to learn from its past. What does this mean for their future and the future of Europe as a whole? Even for the US as a whole should we embrace the rule of the state as completely as they have?

God help us.
Kate

Wow, I had no idea that homeschooling is actually against the law in Germany. Your post was pretty shocking to me. I am surprised that the courts are so adamantly against homeschooling in this day and age. I am going to start following this issue more closely from now on. Thanks for the info here.
